| Abstract: The purpose of this memorandum is to highlight several implementation issues that EPA Regional Offices must address as they implement the federal operating permits program (40 CFR part 71). This memo clarifies that the effective date of the program in Indian country is March 22, 1999 (see 64 FR 8247, February 19, 1999). This document discusses the deadlines for sources to submit part 71 applications and for federal operating permits to be issued. This guidance also clarifies which sources are subject to the program, how sources will be contacted concerning application submittal, and permit fee administration. In addition, this memo discusses the delegation of the part 71 program to tribes and funding for delegated programs. |
