Issuing information request letters is a basic component of nearly all potentially responsible party (PRP) searches. The letters are used for information gathering purposes and do not designate an entity as a potentially responsible party.

Section 104(e) of Superfund authorizes the Agency to issue information request letters to any person (including business entities and government agencies) who may have information about a site, not just to persons who may be PRPs.

Compilation of 104(e) Questions

The compilation of 104(e) information request questions was initially compiled in 1996 and many of the questions were provided by the Regional offices. Since then, the Agency developed questions for information on insurance coverage and application of the Superfund Recycling Equity Act (SREA).

The sample questions are arranged by categories and intended to assist the Regions in tailoring specific information requests based on the kind of PRPs and their involvement at the Site. Note: The Regions use these sample questions at their discretion.
