Construction Activities Located in Massachusetts
The 2003 Construction General Permit (CGP) was issued and became effective in states and territories where EPA is the permitting authority, including the state of New Hampshire, on July 1, 2003. However, administrative delays extended until August 4, 2003 the date the permit was issued and became effective in Massachusetts. The 2003 Construction General Permit contains a 90-day transition period for ongoing projects. For all covered states and territories except Massachusetts (such as New Hampshire), this 90-day transition period ends September 30. For Massachusetts projects, the 90-day transition period ends November 2.
Massachusetts operators who previously notified EPA using the expired NOI form, and whose projects are still ongoing, should resubmit using the new NOI form within 90 days (before November 2, 2003) if their projects won't be completely finished, stabilized and eligible for filing a NOT prior to that date. Prior to submitting your new NOI form, you must update your SWPPP to reflect requirements in the new CGP. Operators with ongoing projects who did not submit the expired NOI form are also allowed the same 90-day period to submit the new NOI form and prepare a SWPPP consistent with the new CGP; however, within this 90-day period, EPA expects that these operators are implementing a SWPPP consistent with the terms of the expired permit. Operators of ongoing projects who submitted the new NOI form prior to August 4, 2003 need not resubmit a new NOI but must insure that their SWPPP satisfies the requirements of the new CGP.
