On June 7, 2007, EPA published a proposed rule in the Federal Register (72 FR 31495) to approve a state implementation plan (SIP) submitted by the State of Pennsylvania. EPA’s adequacy review of the motor vehicle emissions budgets and an opportunity for public comment on the SIP revision are being done concurrently. EPA is proposing approval of the SIP in accordance with the requirements of the Clean Air Act.

Great Smoky Mountains National Park 8-hour ozone maintenance plan (2011 and 2020 NOx Budgets and VOC Insignificance)

The State of North Carolina has requested that EPA parallel process the adequacy review of the proposed SIP revision’s motor vehicle emissions budgets for NOx and a VOC insignificance finding, meaning that EPA will start the public comment period for the adequacy of the SIP budgets prior to the State completing its SIP adoption process.  As in every adequacy review, the public has at least 30 days to comment on the adequacy of this SIP’s motor vehicle emissions budgets.  Should there be any significant changes to the current proposed SIP when the State formally submits the final version to EPA, we will restart the 30-day public comment period for adequacy.  However, if the State submits the current proposed SIP as the final version to EPA, there will not be another comment period before EPA makes its adequacy finding.

The correct motor vehicle emissions budget of 680 tons per day (tpd) for NO2 can be found in Appendix III (Table C-1) of the 2007 South Coast Adopted Air Quality Management Plan. The SIP as revised by the technical correction includes an Attachment with a revised Table 6-11, which lists the motor vehicle emissions budget for NO2 for 2002.

Note that we interpret the existing language in Footnote 2 to the table as creating the same budget for 2002 and 2020. We believe that the AQMD did not intend to create a budget for every year in between 2002 and 2020 and beyond 2020 because this would be unreasonable.
