National Historic Preservation Act
As part of the permit process at Siemens, EPA must comply with the National Historic Preservation Act (NHPA). The NHPA requires EPA to identify any historic properties that may be affected by operations at Siemens, and to take those historic properties into consideration during our draft permit decision. The term "historic properties" includes properties of traditional religious and cultural importance to an Indian Tribe. For more information about the National Historic Preservation Act, see the “Citizen’s Guide to Section 106 Review.” EPA worked with four consulting parties during the NHPA process: The Colorado River Indian Tribes, the Arizona State Historic Preservation Officer, the Town of Parker, and Siemens. EPA also notified 13 Tribes and 5 local, state, and federal agencies asking whether they were interested in participating in the process as consulting parties.
On January 31, 2007, EPA issued a public notice designating an Area of Potential Effects on historic properties around Siemens. This is one of the first steps in the NHPA process. This public notice also requested information on any historic properties within the Area of Potential Effects, and whether there may be adverse effects to the historic properties from EPA’s draft permit decision at Siemens. On March 27, 2007, EPA extended the public comment period for information on any historic properties within the Area of Potential Effects, and whether there may be adverse effects to the historic properties within the Area of Potential Effects from EPA’s draft permit decision at Siemens. EPA received comments on the identification and impacts on historic properties within the Area of Potential Effects under the NHPA. EPA is currently reviewing the comments and preparing a response.
