BACKGROUND:

As many of you know, we have activated the webpage for the Tribal NSR Registration Calculators.  This webpage provides the information and tools that may help sources determine if they are required to register their "true" minor source of air pollution with the EPA.

On June 10, 2011, the EPA finalized the Tribal New Source Review (NSR) Rule  http://www.gpo.gov/fdsys/pkg/FR-2011-07-01/pdf/2011-14981.pdf , which helps to protect air quality in Indian country. Under the Tribal NSR Rule, existing "true" minor sources that emit air pollution at certain levels must register their facility with the EPA by March 1, 2013. True minor air pollution sources are generally small businesses or operations such as neighborhood dry cleaners or gas stations. In order to help true minor sources register, we developed calculators for common source types to help them determine if they must register under this rule. 

There are 11 calculators in all and they can be found under the Additional Links section on  the Tribal NSR website: http://www.epa.gov/air/tribal/tribalnsrcalculators.html.  If there is not a registration calculator for a specific source category, then the source can use  the registration form located at: http://www.epa.gov/air/tribal/pdfs/existing_source_registration_rev.doc

SUBJECT: Webinar on Tribal New Source Review Implementation

EPA conducted a webinar on the Implementation of the Tribal New Source Review (NSR) Program. NSR is a Clean Air Act program commonly known as the “preconstruction air permitting program” that requires industrial facilities to install modern pollution control equipment when they are built or when making a change that increases emissions significantly.

The Tribal New Source Review rule finalizes a Federal Implementation Plan (FIP) for the major NSR program in nonattainment areas and the minor NSR program for both attainment and nonattainment areas in Indian country. Webinar Series on New Source Review (NSR) Program for Tribes

EPA conducted three webinars (four webinars were scheduled with the third webinar being cancelled and may be rescheduled) on the New Source Review (NSR) Program as shown below. The first webinar in this series focused on the Prevention of Significant Deterioration (PSD) and the Nonattainment NSR (NA NSR). The second webinar focused on the Minor NSR Program and the third webinar will be on the Implementation of the NSR rule.

NSR is a Clean Air Act program commonly known as the “preconstruction air permitting program” that requires industrial facilities to install modern pollution control equipment when they are built or when making a change that increases emissions significantly. The NSR is divided into three parts: the PSD, the NA NSR and the Minor NSR program.

EPA recently finalized a NSR rule that will establish the major NSR program in nonattainment areas and the minor NSR program for both attainment and nonattainment areas in Indian country. The purpose of these webinars is to inform and train tribal environmental professionals interested in knowing more about NSR and the rule or that will be in charge of implementing the rule.

The webinars summarized the most relevant provisions of the PSD, major NA NSR and minor NSR programs and provided the opportunity for participants to ask questions. Previous background on NSR would be very helpful, but not necessary.
