Alternate submittal deadline for Initial Monitoring Plans and Certification Applications for the Clean Air Mercury Rule (CAMR) and Clean Air Interstate Rule (CAIR) for Sulfur Dioxide.
CAIR SO2 and CAMR affected sources must complete initial certification of the required monitoring systems for these programs by January 1, 2009. The regulations require that before any certification tests are begun, an initial monitoring plan and test notice are to be submitted at least 21 days prior to commencing certification testing. Furthermore, once all certification tests have been completed, sources are required to submit the test data in the form of a certification application no later than 45 days after completion of the last certification test. The required electronic portions for each of these submissions will be collected only in XML format using the Agency's new Emission Collection and Monitoring Plan System (ECMPS). However, the ECMPS client tool software (which is required to evaluate XML formatted data and facilitate submission of that data to EPA's host database) will not be available until March 2008. Therefore, it will not be possible for sources that begin certification activities in early 2008 to comply with the regulatory submittal deadlines for the initial monitoring plans and certification applications. In recognition of this, sources may request an alternate submittal deadline for initial monitoring plans and certification applications that would be required sooner than 90 calendar days following the release of the ECMPS Client Tool software. For any such submittals, sources could request up to 90 calendar days following the official release of the ECMPS Client Tool software to submit their monitoring plan and certification data. EPA will make the ECMPS software available on the Clean Air Markets web site (http://www.epa.gov/airmarkets) and will note at that time the release date and the resulting alternate deadline for these submittals.
Sources must submit a request to EPA to use this alternate deadline. Sources should send a written request in the form of a petition under §75.66 to Sam Napolitano, Director; Clean Air Markets Division; 1200 Pennsylvania Avenue, NW; Mail Code 6204J; Washington, DC 20460. Please also copy Matthew Boze at the same address. The subject line of the request should read "Request for Alternate Submittal Deadline in 2008 for CAIR SO2 and/or CAMR Initial Monitoring Plans and/or Certification Applications". The request should list the units for which the alternate deadline is requested. (Click here for a sample petition.) Requests should be received before certification testing is completed, but no later than 45 days following completion of the last required certification test.
