Nelson Industrial Steam Company (NISCO) filed comments with the EPA objecting to the inclusion of its two 130 megawatt units in CAIR . NISCO suggested that the units should be exempt from CAIR because they produce a minimal amount of electricity for sale and they qualify as a cogeneration units under Public Utility Regulatory Practices Act (PURPA). EPA has determined that the units are subject to CAIR, and the complete applicability determination can be found here. On 11/26/07 NISCO filed a Petition for Review of the Applicability Determination with the Environmental Appeals Board; EPA responded on 2/28/08.
