Cross-State Air Pollution Rule (CSAPR)

The United States Court of Appeals for the D.C. Circuit issued its ruling to stay the CSAPR pending judicial review. The court's decision is not a decision on the merits of the rule. EPA is ensuring the transition back to the Clean Air Interstate Rule (CAIR) occurs as seamlessly as possible. Please see our Bulletins page for updates on CSAPR and the continuing implementation of CAIR.
The Cross-State Air Pollution Rule (CSAPR) requires states to significantly improve air quality by reducing power plant emissions that cross state lines and contribute to ozone and fine particle pollution in other states. In a separate, but related, regulatory action, EPA finalized a supplemental rulemaking on December 15, 2011 to require five states - Iowa, Michigan, Missouri, Oklahoma, and Wisconsin - to make summertime NOX reductions under the CSAPR ozone season control program. CSAPR requires a total of 28 states to reduce annual SO2 emissions, annual NOX emissions and/or ozone season NOX emissions to assist in attaining clean air standards. To speed implementation, EPA is adopting Federal Implementation Plans, or FIPs, for each of the states covered by this rule. EPA is encouraging states to submit State Implementation Plans (SIPs) starting as early as 2013.

CSAPR 2012 and 2013 Allowance Allocation
On October 18, 2011, EPA placed 2012 allowances for all four CSAPR programs into accounts for sources with a certified account Designated Representative (DR). DRs are now in place covering 86 percent of CSAPR's 3,600 units at facilities. On October 25, 2011, EPA placed the 2013 control period allowances in accounts of sources in states which have not indicated that they will be determining 2013 allowance allocations. As of the October 17, 2011 deadline, twelve states notified EPA that they intended to distribute 2013 CSAPR allowances to sources in their states: Alabama, Florida, Kansas, Maryland, Mississippi, Missouri, Louisiana, Nebraska, New York, Ohio, Pennsylvania, and South Carolina. Once the proposed CSAPR revisions are finalized, any remaining CSAPR allowances will be placed in accounts as soon as possible. The allowances that are being placed into accounts reflect the allocation from the final CSAPR (PDF 276pp) 
and will be adjusted to reflect recent proposed CSAPR revisions (PDF 19 pp) to the extent any revisions are finalized. Because EPA proposed revisions to CSAPR on October 6, it was necessary to ensure that allocations placed into accounts did not exceed the proposed revisions. For each unit, allocations from the final CSAPR were compared to allocation levels in the proposed revisions to CSAPR. The number of allowances placed in accounts was the same as the level stipulated in the final CSAPR unless a unit's allocations under the proposed CSAPR revisions were less than under the final CSAPR, in which case the level stipulated in the proposed CSAPR revisions was placed in the account.

* The final CSAPR divides the states required to reduce SO2 into two groups. Both groups must reduce their SO2 emissions beginning in 2012. Group 1 states must make significant additional reductions in SO2 emissions by 2014 in order to eliminate their significant contribution to air quality problems in downwind areas.
