EPA PROPOSES $38,000 FINE FOR LEWISTON FACILITY

BOSTON - The Environmental Protection Agency is proposing to fine Pepperell Associates of Lewiston, Maine $38,730 for Clean Water Act violations stemming from an oil spill last October.

EPA and Maine DEP staff responded to an oil spill from the facility Oct. 17 that leaked an estimated 400 to 600 gallons of thick, black, Number 6 oil into Gully Brook, a tributary of the Androscoggin River. The EPA is proposing the fine for the spill itself, and also because the company did not have a federally required spill plan.

The spill resulted from a ruptured gasket in the basement boiler room.

"Any business or organization keeping fuel tanks should exercise great care in their upkeep, while also maintaining an up-to-date spill plan should an accident occur," said John P. DeVillars, administrator of the EPA's New England office. "We'll now sit down at the bargaining table with Pepperell Associates to come up with a settlement that properly reflects the severity of the violation and ensures that no accidents take place in the future."

The EPA is proposing to fine the company $25,230 for the company's failure to have a plan, and $13,500 for the spill.

Peperell Associates owns and leases the former Pepperell Mill on 550 Lisbon Street. The partnership has converted the building into office space.
