Both initial proposals and formal request for funding are subject to the Freedom of Information Act. This means that anyone can request, and receive, copies of information contained in proposals that is not exempt from disclosure under FOIA. Applicants must clearly mark information they consider confidential. U.S. EPA will make final confidentiality decisions in accordance with agency regulations (40CFR part 2, subpart B).

Any disputes regarding funding decisions will be resolved in accordance with 40 CFR part 30 or 31, depending on the applicant. U.S. EPA reserves the right to reject all applications and make no awards.
