Subpart W – Petroleum and Natural Gas Systems

Rule Information

On March 19, 2012 EPA extended the comment period until April 9, 2012 for a proposal to determine which data elements reported under subpart W of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). More information.

On February 24, 2012, EPA issued a proposal to determine which data elements reported under subpart W of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). These data elements will be reported to EPA for the first time in September 2012. In addition, this action proposes to defer the deadline for reporting some recently added subpart W data reporting elements that are “inputs to emission equations” until 2015.

On December 23, 2011, EPA issued a final rule that amends specific provisions in subparts A and W. These revisions correct technical and editorial errors and address issues identified as a result of questions received from reporters. These amendments do not change the overall requirements, but improve clarity and consistency across the calculation, monitoring and data reporting requirements.

On September 27, 2011, EPA issued a rule that finalized amendments to the best available monitoring methods (BAMM) provisions in subpart W. With these amendments, owners and operators of facilities covered by subpart W are now permitted to use BAMM for calendar year 2011 without being required to submit a request for approval from the Administrator. In addition, EPA has expanded the types of emission sources that are permitted to use BAMM in 2011 without being required to submit a request for approval from the Administrator. Lastly, these amendments give owners and operators additional time to request to use BAMM beyond 2011.

On November 8, 2010, Administrator Jackson signed a rule that finalizes reporting requirements for the petroleum and natural gas industry under 40 CFR Part 98, the regulatory framework for the Greenhouse Gas (GHG) Reporting Program. This final rule requires petroleum and natural gas facilities that emit 25,000 metric tons or more of carbon dioxide (CO2) equivalent per year to report annual methane (CH4) and CO2 emissions from equipment leaks and venting, and emissions of CO2, CH4, and nitrous oxide (N2O) from gas flaring and from onshore petroleum and natural gas production stationary and portable combustion emissions and combustion emissions from stationary equipment involved in natural gas distribution.
