Importing and Exporting Chemical Substances

EPA regulates certain chemical substances under the Toxic Substances Control Act (TSCA). TSCA governs the import and export of toxic chemicals from the United States.

Imports of Chemicals

United States Customs and Border Protection regulations under TSCA section 13 (19 CFR 12.118 to 12.128 and 127.28) require that the importer of a chemical substance or mixture certify that the shipment either complies with TSCA and all applicable rules and orders thereunder (positive certification), or is not subject to TSCA (negative certification).  The TSCA certification applies to TSCA section 5, 6, and 7 and actions thereunder.  See also 40 CFR 707.20.  Additionally, importers may have obligations pursuant to actions under TSCA sections 4 (testing) and 8 (reporting and recordkeeping).

Exports of Chemicals

TSCA Section 12(b) and 40 CFR Part 707 requires EPA to notify importing countries of the export of chemicals or mixtures that are subject to certain rules and orders. Approximately 1,100 chemicals come under this requirement. Additionally,  EPA regulates the distribution in commerce  for export of  certain chemical substances, including PCBs and asbestos.
