Definitions
1. What activities are covered by the term "produce"?
"Produce" means to manufacture, prepare, compound, propagate or process any pesticide or device or active ingredient used in producing a pesticide, active ingredient or device. Additionally, packaging, repackaging, labeling, relabeling or otherwise changing the container of any pesticide or device also is production. (Note: This includes repackaging of pesticides in bulk containers.)
"Device" means any instrument or contrivance (other than a firearm) that is intended for trapping, destroying, repelling, or mitigating any pest or any other form of plant or animal life (other than man and other than bacteria, virus, or other microorganism on or in living man or other living animals); but not including equipment used for the application of pesticides when sold separately therefrom. A "custom blender" is defined as any establishment that provides the service of mixing registered pesticides to a customer’s specifications, specifically:
- a pesticide-pesticide blend
- a pesticide-fertilizer blend
- a pesticide-animal feed mixture
when
- the blend is not held in inventory
- the pesticide used in producing the blend bears labeling that does not prohibit the use of the pesticide in the blend
- the blend is delivered to the end-user with a copy of the labeling of the pesticide used in producing the blend and a statement specifying the composition of the mixture
If these conditions are not met, the establishment does not meet the definition of "custom blender" and must comply with FIFRA Section 7 requirements.
4. What constitutes "bulk repackaging" of pesticides?
"Bulk repackaging" means the repackaging of pesticides into refillable containers that are designed and constructed to accommodate the return and refill of greater than 55 gallons or 100 pounds of product.
