The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) State and Tribal Assistance Grant (STAG) Program seeks to assist states, territories, the District of Columbia and Indian tribes:
- in developing and maintaining comprehensive pesticide programs that address all aspects of pesticide enforcement and special pesticide initiatives
- sponsor cooperative surveillance, monitoring and analytical procedures
- encourage regulatory activities within the states and tribes
In general, states have primary authority for compliance monitoring and enforcement of pesticides use.
Two specific compliance monitoring and enforcement activities have been identified as major priorities for this program:
- the pesticide worker protection program
- pesticides used to protect public health
Other typical program activities include:
- inspections and observations at pesticide application sites to ensure user compliance with label directions and acceptable use practices
- inspections of pesticide products at producing facilities and in the retail marketplace to ensure industry compliance with registration, classification and labeling requirements
- initiation of appropriate enforcement action when violations are detected including civil and criminal prosecution, stop sale orders, seizures, recalls and warning notices
The statutory authority for this cooperative agreement program can be found at Section 23(a) of FIFRA (7 USC sec. 136u).
The FIFRA STAG compliance monitoring program annually awards approximately 19.2 million dollars to establish and operate compliance monitoring programs in 49 authorized states, 6 territories and 23 tribes under FIFRA to conduct pesticide compliance and enforcement programs. Additional funds are awarded by the Office of Pesticide Programs for certification and training, water quality and endangered species programs.
