 May 2008: EPA has completed a study to better characterize fugitive mercury emissions from chlorine manufactures that use mercury cell technology. Study findings show that mercury emissions average about 0.2 tons per year per facility. EPA is also proposing to require manufacturers of chlorine using mercury cell technology to take additional steps to prevent mercury emissions. • April 2008: EPA issued instruction manuals to promote safe mercury and chemical management in secondary schools at the “Mercury in Our World Conference on Mercury and Other Hazardous Chemicals in Southeast Asia Schools” in Thailand, April 22-24, 2008.

February 2008: the United States Court of Appeals for the District of Columbia Circuit in State of New Jersey, et al. v. Environmental Protection Agency (PDF) (18 pp., 51K, about PDF) vacated (i.e., voided) EPA's rule removing power plants from the Clean Air Act list of sources of hazardous air pollutants. At the same time, the court vacated the Clean Air Mercury Rule. On March 24, EPA asked the full court to reconsider the decision in a petition for rehearing. The court denied EPA's petition for rehearing on May 20. EPA is reviewing the court's decision and determining how to proceed.
