Subpart I: Certain Federal Facilities



Description of Source:Subpart I applies to those federal facilities that are not regulated elsewhere.
The following facilities are not covered by Subpart I:
  • DOE facilities (see Subpart H);
  • Nuclear Regulatory Commission licensees and Agreement State licensees (subject to NRC's regulatory program);
  • disposal activities that are subject to 40 CFR Part 191, Subpart B;
  • low-energy accelerators; and
  • uranium mill tailings piles covered under 40 CFR Part 192.


The Standard:Subpart I limits radionuclide emissions in two ways:

  1. emissions of radionuclides, including iodine, shall not exceed those amounts that would cause any member of the public to receive more than an annual effective dose equivalent of 10 mrem/yr; and
  2. emissions of iodine shall not exceed those amounts that would cause any member of the public to receive an annual effective dose equivalent of 3 mrem/yr.


Reporting Requirements:Facility owners and operators must calculate the effective dose equivalent each year and report to EPA annually. Annual reports will include a list of the radioactive materials used at the facility; a description of the handling and processing that radioactive materials undergo at the facility; a list of emission points and their distances to the nearest residence, school, business/office, and producing farm; and a brief description of all construction or modifications made to the facility during the year. Facilities are exempt from these reporting requirements if the calculated effective dose equivalent from all emissions from the facility is less than 10% of the standard. Facilities that are not in compliance must report monthly to EPA.

Facility owners and operators must also apply to EPA to construct or modify a facility, unless:

  • the calculated effective dose equivalent from all emissions from the facility is less than 10% of the standard; or
  • the calculated effective dose equivalent caused by all emissions from the new construction or modification is less than 1% of the standard.
