Reporting Off-Site Transfers of Spent Solution Under EPCRA Section 313 (40 CFR Part 372), a covered facility is required to report all releases and waste management activities involving toxic chemicals for which the facility has exceeded an activity threshold. A covered facility uses a solution containing nitric acid to strip elemental nickel from plating racks. During the stripping process, nickel nitrate is manufactured in the solution. When the stripping of the racks becomes inefficient, the spent solution (containing nitric acid and nickel nitrate) is sent off site to a facility that recovers the nickel, then treats the remainder of the spent solution and ultimately discharges the treated stream to a POTW. What activity thresholds apply to the nitric acid and nickel nitrate? How should the transfer of the spent solution be reported in Part II, Sections 6 and 8 of the Form R? Nitric acid in the solution used to strip nickel from plating racks must be applied towards the 10,000-pound otherwise use activity threshold for nitric acid. Nickel nitrate meets the listing description for both the nickel compounds category and the water dissociable nitrate compounds category. Therefore, the entire weight of nickel nitrate coincidentally manufactured during the stripping operation must be counted toward the 25,000-pound manufacturing thresholds for both the water dissociable nitrate compounds and the nickel compounds categories. EPCRA Section 313 requires all releases and waste management activities to be reported for toxic chemicals that exceed an activity threshold. Because the spent solution (containing nickel nitrate and nitric acid) is transferred off site for nickel recovery, the nickel compounds would be reported as transferred off site for recycling in Part II, Sections 6.2 and 8.5. Only the parent metal (nickel) portion of the nickel compounds sent off site must be counted when determining the amount to be reported in Sections 6.2 and 8.5. Reports for nitric acid and the nitrate compounds category must reflect the amount of nitric acid and nitrate ion, respectively, sent off site for treatment in Sections 6.2 and 8.7. 2. Conversion of Anhydrous Ammonia to Aqueous Ammonia EPCRA Section 313 (40 CFR Part 372) requires covered facilities to report on all releases and other waste management activities for listed toxic chemicals that they manufacture, process, or otherwise use above the applicable threshold quantity. A covered facility otherwise uses ammonia, a listed Section 313 toxic chemical, in a system at its facility. In the system, anhydrous ammonia is sent through a scrubber and becomes aqueous ammonia. The aqueous ammonia is discharged to a POTW. Under EPCRA Section 313, all (100 percent) of the anhydrous ammonia entering the system during a reporting year must be included in the activity threshold determination for ammonia. However, due to a special qualifier on the listing for ammonia, only 10 percent of the aqueous ammonia discharged to the POTW must be reported on the Form R as sent off site for treatment in Part II, Sections 6.1 and 8.7. Must the amount of anhydrous ammonia sent through the scrubber be reported as treated on site in Section 8.6? The conversion of anhydrous ammonia to aqueous ammonia is not considered treatment on site of a toxic chemical for the purposes of Section 8.6. Section 8.6 of the Form R includes only the amount of the Section 313 toxic chemical that is actually treated and destroyed. Treatment for destruction requires the conversion of a toxic chemical such that the substance is no longer the toxic chemical subject to reporting under EPCRA Section 313. Ammonia (including anhydrous ammonia and aqueous ammonia from water dissociable ammonium salts and other sources) is the Section 313 listed toxic chemical. In the above scenario, none of the toxic chemical (ammonia) was destroyed; rather, the anhydrous ammonia was dissolved in water and converted to aqueous ammonia. The conversion of anhydrous ammonia to aqueous ammonia is not reported as "treatment for destruction" in Section 8.6 since no ammonia was actually destroyed. New Publications How to order. Final Rules RCRA Montana: Final Authorization of State Hazardous Waste Management Program Revision August 8, 2000 (65 FR 48392) EPA withdrew the immediate final rule published on May 9, 2000, which approved the third revision to Montana's hazardous waste rules. The immediate final rule was withdrawn because comments opposed this authorization. CAA Redefinition of the Glycol Ethers Category under Section 112(b)(1) of the Clean Air Act and Section 101 of CERCLA August 2, 2000 (65 FR 47342) This action deletes each individual compound in a group called the surfactant alcohol ethoxylates and their derivatives (SAED) from the glycol ethers category in the list of hazardous air pollutants (HAP) established by Section 112(b)(1) of CAA. This action is also making conforming changes with respect to designation of hazardous substances under CERCLA. EPA was issuing these final rules in response to an analysis of potential exposure and hazards of SAED that was prepared by the Soap and Detergent Association (SDA). Accidental Release Prevention Requirements; Risk Management Programs under the Clean Air Act Section 112(r)(7); Distribution of Off-Site Consequence Analysis Information; Final Rule August 4, 2000 (65 FR 48107) EPA and the Department of Justice (DOJ) are promulgating a rule that provides for access to information concerning the potential off-site consequences of hypothetical accidental chemical releases from industrial facilities. Under the Clean Air Act (CAA) Section 112(r), facilities handling large quantities of extremely hazardous chemicals are required to include that information in a risk management plan (RMP) submitted to EPA. As required by the Chemical Safety Information, Site Security and Fuels Regulatory Relief Act (CSISSFRRA), this rule provides members of the public and government officials with access to that information in ways designed to minimize the likelihood of accidental releases, the risk to national security associated with posting the information on the Internet, and the likelihood of harm to public health and welfare. This rule became effective on August 4, 2000. If the proposed delisting becomes final, Tyco's petitioned waste will no longer be classified as F006, and will not be subject to regulation as a hazardous waste under Subtitle C of RCRA. Project XL Site-Specific Rulemaking for US Filter Recovery Services, Roseville, MN, and Generators and Transporters of USFRS XL Waste August 17, 2000 (65 FR 50283) EPA proposed under its Project XL program that would provide regulatory flexibility under RCRA, for the US Filter Recovery Services (USFRS) facility located in Roseville, Minnesota, and approved Minnesota generators and transporters of wastes. This should encourage the use of wastewater treatment ion exchange resins. Amendments to the Corrective Action Management Unit Rule August 22, 2000 (65 FR 51079) EPA proposed amendments to the regulations governing CAMUs concerning types of wastes managed, CAMU design standards, waste treatment requirements, information submission requirements, response to releases, and public participation. Also, the amendments will "grandfather" certain CAMU categories and create new requirements for CAMUs used only for treatment or storage. This action also requested comments on a potential change to the staging pile regulations. Finally, this action proposed an approach to state authorization that would grant interim authorization for these amendments to most states currently authorized for the CAMU rule. EPA will accept public comment on this proposed rule until October 23, 2000. Notices RCRA Underground Injection Control Program; Hazardous Waste Injection Restrictions; Petition for Exemption-Class I Hazardous Waste Injection; Amoco Petroleum Products August 3, 2000 (65 FR 47727) EPA gave notice that an exemption to the land disposal restrictions has been granted to Amoco Petroleum Products (Amoco) for three Class I injection wells located at Texas City, Texas. As required by 40 CFR Part 148, the company demonstrated that there will be no migration of hazardous constituents from the injection zone for as long as the waste remains hazardous. Public Information Hearings on Discharges from Cruise Ships August 11, 2000 (65 FR 49239) EPA, supported by the Coast Guard and other federal agencies, announced that it will be hosting three regional public information hearings to gather information regarding the management of wastewater, solid waste, hazardous waste, and other discharges by cruise ships. Ultimately, an assessment of the quality and quantity, environmental impacts, existing control measures, and possible regulation of discharges from cruise ships will be prepared. Regulatory Reinvention (XL) Pilot Projects August 14, 2000 (65 FR 49571) EPA requested comments on a proposed Project XL Final Project Agreement (FPA) for Autoliv Automobile Safety Products, U.S.A. The FPA is a voluntary agreement developed collaboratively by Autoliv, the State of Utah, and EPA. Regulatory Reinvention (XL) Pilot Projects; Notice of Availability of Yolo County Accelerated Anaerobic & Aerobic Composting (Bioreactor) Project XL Draft Final Project Agreement August 29, 2000 (65 FR 52426) EPA requested comments on a draft Project XL Final Project Agreement (FPA) for Yolo County, Woodland, California. As part of this proposal, Yolo County is requesting EPA to grant regulatory flexibility under RCRA for liquid restrictions in landfills. The period for submission of comments on the draft FPA ends on September 12, 2000. CERCLA National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List August 2, 2000 (65 FR 47363) EPA announced the intent to delete the Newsom Brothers Superfund Site from the NPL. Notification of Proposed Policy Change; Superfund Construction Completion List August 4, 2000 (65 FR 47988) EPA proposed to revise its policy with respect to the Construction Completion category established in the NPL under CERCLA. Existing Agency policy had limited sites eligible for inclusion to the Construction Completion List (CCL) to sites that are on the NPL at the time a determination is made that all physical construction has been completed. As a result, deleted sites would never qualify for the CCL if physical construction remains at the time of deletion from the NPL. The proposed policy would allow all sites that are on the NPL or have been deleted from the NPL to be eligible for the CCL when all physical construction under all authorities is complete and all other applicable construction completion policy criteria have been satisfied. This will allow Superfund to track and report completion of all construction activities at NPL sites. Comments on the proposed policy change must be submitted by September 5, 2000. National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List Update August 10, 2000 (65 FR 48930) EPA announced the deletion of the Schofield Army Barracks Site in Honolulu County, Oahu, Hawaii, from the NPL. National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List August 14, 2000 (65 FR 49528) EPA announced its intent to delete the release from the Route 940 Drum Dump from the NPL. Peer Review for Superfund Probabilistic Risk Guidance August 21, 2000 (65 FR 50694) EPA announced that Eastern Research Group (ERG), an EPA contractor for external scientific peer review, will organize, convene, and conduct an external peer review panel workshop to review the draft document titled, "Risk Assessment Guidance for Superfund Volume 3 Part A: Process for Conducting Probabilistic Risk Assessment (RAGS 3A)". RAGS 3A provides guidance on conducting site-specific human health and ecological probabilistic risk assessment (PRA) under Superfund. ALL PROGRAM AREAS Change of Official EPA Mailing Address; Technical Amendments August 2, 2000 (65 FR 47323) EPA is relocating the majority of its Headquarters offices in the Washington Metropolitan area to new offices in downtown Washington, DC. Because of the relocations, EPA has changed its official mailing address and is amending the CFR to reflect this change where applicable. Although the official mailing address has changed, the physical location of the public information centers and dockets has not yet changed. This relocation effort will eventually consolidate the EPA Headquarter offices in the Washington Metropolitan area providing for increased savings, efficiency, and enhancement of customer services. The EPA mailing address change will be phased in for all EPA correspondence, publications, forms, and other documents.
