Clarification of Standards for Hazardous Waste LDR Treatment Variances Final Rule - December 1997EPA responded to comments submitted in response to the proposal to clarify the standards for review and approval of variances from the hazardous waste land disposal restriction treatment standard. Clarification was proposed on May 12, 1997 as part of the Land Disposal Restrictions Phase IV: Second Supplemental Proposal on treatment Standards for Metal Wastes and Mineral Processing Wastes, Mineral Processing and Bevill Exclusion Issues, and the Use of Hazardous Waste as Fill. The clarifying changes adopt EPA's longstanding interpretation that a treatment variance may be granted when treatment of any given waste to the level or by the method specified in the regulations is not appropriate, whether or not it is technically possible to treat the waste to that level or by that method. In response to comment, the Agency also provides guidance on review and approval of site-specific variances from land disposal treatment standards and on incorporating such variances into a site remediation or cleanup process. EPA also offers guidance on use of site-specific cleanup levels as alternative land disposal restriction treatment standards in cases where variances are approved.
