ENVIRONMENTAL PROTECTION AGENCY 40 CFR Parts 52 and 81 [OH60-1-6377b; FRL-5410-2] Approval and Promulgation of Air Quality Implementation Plans, and Designation of Areas for Air Quality Planning Purposes; Ohio AGENCY: Environmental Protection Agency (USEPA). ACTION: Proposed rule.
SUMMARY: The USEPA proposes to approve the ozone State Implementation Plan (SIP) revision and redesignation requests submitted by the State of Ohio for the purpose of redesignating Franklin, Delaware, and Licking Counties (Columbus area) from nonattainment to attainment for ozone; and revise Ohio's SIP to include a 1990 base-year ozone precursor emissions inventory for the Columbus ozone nonattainment area. In the final rules section of this Federal Register, the USEPA is approving this action as a direct final rule without prior proposal because USEPA views this as a noncontroversial action and anticipates no adverse comments. A detailed rationale for the approval is set forth in the direct final rule. If no adverse comments are received in response to that direct final rule, no further activity is contemplated in relation to this proposed rule. If USEPA receives adverse comments, the direct final rule will be withdrawn and all public comments received will be addressed in a subsequent final rule based on the proposed rule. It should be noted, however, that an adverse or critical comment on the direct final approval of the Columbus area redesignation request or maintenance plan will not result in a withdrawl of the direct final approval of the Columbus emission inventory, unless USEPA receives adverse or critical comments on the emission inventory approval, as well. USEPA will not institute a second comment period on this action. Any parties interested in commenting on this document should do so at this time.
