Approval and Promulgation of State Plans for Designated 
Facilities; New York

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: The Environmental Protection Agency (EPA) is proposing to 
approve the State Plan submitted by New York to fulfill the 
requirements of sections 111(d)/129 of the Clean Air Act for Municipal 
Waste Combustors (MWC). The State Plan addresses the implementation and 
enforcement of the Emissions Guidelines (EG) applicable to existing 
large MWCs with capacity to combust more than 250 tons per day of 
municipal solid waste. The State Plan imposes emission limits and 
control requirements for the existing MWC's in New York which will 
reduce the designated pollutants. In the final rules section of this 
Federal Register, EPA is approving New York's MWC State Plan as a 
direct final rule without prior proposal because the Agency views this 
as a noncontroversial action and anticipates no relevant adverse 
comments. A detailed rationale for the approval is set forth in the 
direct final rule. If no relevant adverse comments are received in 
response to that direct final rule no further activity is contemplated 
in relation to this proposed rule. If EPA receives relevant adverse 
comments, the direct final rule will be withdrawn and all public 
comments received will be addressed in a subsequent final rule based on 
this proposed rule.
    The EPA will not institute a second comment period on this action. 
Any parties interested in commenting should do so at this time.
