DEPARTMENT OF JUSTICENotice of Lodging of Consent Decree Pursuant to the Comprehensive Environmental Response, Compensation and Liability Act, ``CERCLA'' In accordance with Departmental policy, 28 CFR 50.7, notice is hereby given that a proposed consent decree in United States v. Pretty Products, Inc., et al, Civil Action No. C2-91-074 (S.D. Ohio), was lodged on October 28, 1994 with the United States District Court for the Southern District of Ohio. The decree resolves claims against Pretty Products, Inc. and the Lancaster Colony Corporation, under Sections 104(e) and 107(a) of the Comprehensive Environmental Response, Compensation and Liability Act, as amended (``CERCLA''), 42 U.S.C. 9604(e) and 9607, in connection with a hazardous waste site known as the Coshocton Landfill site (the ``Site'') located in Coshocton County, Ohio. The proposed decree requires defendant, Pretty Products, to pay to the Hazardous Substance Superfund, as reimbursement for response costs previously incurred by the United States in connection with the Site, the sum of $1,750,000, with interest from July 1, 1994. In addition, Defendants will pay costs incurred by the United States in overseeing remedial action work that is being undertaken by other Potentially Responsible Parties (``PRPs'') at the Site, to the extent that such oversight costs are not reimbursable under a separate settlement between the United States and those other PRPs. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed consent decree. Comments should be addressed to the Acting Assistant Attorney General, Environment and Natural Resources Division, Department of Justice, Washington, DC 20530, and should refer to United States v. Pretty Products, Inc., et al, D.J. reference #90-11-2-214A. The proposed consent decree may be examined at the Office of the United States Attorney for the Southern District of Ohio, Nationwide Bank Building, 280 N. High Street, Columbus, Ohio 43215; the Region V Office of the Environmental Protection Agency, 77 West Jackson boulevard, Chicago, Illinois; and at the Consent Decree Library, 1120 G Street NW., 4th floor, Washington, DC 20004, (202) 624-0892. A copy of the proposed consent decree may be obtained in person or by mail from the Consent Decree Library. In requesting a copy, please enclose a check in the amount of $7.00 (25 cents per page reproduction costs), payable to the Consent Decree Library.
