Notice of Lodging of Consent Decree Pursuant to the Clean Water Act

In accordance with Departmental policy, 28 CFR 50.7, notice is hereby given that a proposed amendment to the consent decree in United States v. Kodiak Reduction, Inc., et al., Civil Action No. A92-750, was lodged on January 25, 1995 with the United States District Court for the District of Alaska. The complaint in this case alleged claims arising out of the discharge of seafood processing waste into waters off Kodiak Island, Alaska. The decree provides for construction and operation of a fishmeal plant to process these waters. The proposed amendment will establish additional effluent limitations and operating conditions on this plant.
Because the plant is needed to process waste in the fishing season due to begin at the end of January, the Department of Justice will receive, for a period of ten (10) days from the date of this publication, comments relating to the proposed amendment. Comments should be addressed to the Assistant Attorney General for the Environment and Natural Resources Division, Department of Justice, Washington, D.C. 20530, and should refer to United States v. Kodiak Reduction, Inc., et al., DOJ Ref. #90-5-1-1-3620. The proposed amendment may be examined at the office of the United States Attorney, 222 W. 7th Ave., Anchorage, Alaska, the Region 10 Office of the Environmental Protection Agency, 1200 Sixth Avenue, Seattle, Washington and at the Consent Decree Library, 1120 G Street, N.W., 4th Floor, Washington, D.C. 20005, (202) 624-0892. A copy of the proposed consent decree may be obtained in person or by mail from the Consent Decree Library, 1120 G Street, N.W., 4th Floor, Washington, D.C. 20005. In requesting a copy please refer to the referenced case and enclose a check in the amount of $2.25 payable to the Consent Decree Library.
