Notice of Final Federal Agency Actions on Proposed Highway in California

AGENCY: Federal Highway Administration (FHWA), DOT.
ACTION:  Notice of limitation on claims for judicial review of actions 
by FHWA and other Federal agencies.

SUMMARY: This notice announces actions taken by the FHWA and other 
Federal agencies that are final within the meaning of 23 U.S.C. 
139(l)(1). These actions relate to a proposed highway project, State 
Route 46 Corridor Improvement Project between Kilo Posts 51.8 to 90.6 
(Post Miles 32.2 to 56.3) in San Luis Obispo County, State of 
California. These actions grant approvals for the project.

DATES: By this notice, the FHWA is advising the public of final agency 
actions subject to 23 U.S.C. 139(l)(1). A claim seeking judicial review 
of the Federal agency actions on the highway project will be barred 
unless the claim is filed on or before December 5, 2006. If the Federal 
law that authorizes judicial review of a claim provides a time period 
of less than 180 days for filing such claim, then that shorter time 
period still applies.

SUPPLEMENTARY INFORMATION: Notice is hereby given that the FHWA and 
other Federal agencies have taken final agency actions by issuing 
approvals for the following highway project in the State of California. 
This project would improve safety and provide congestion relief on 
State Route 46, San Luis Obispo County, California. This would be 
accomplished by creating an additional travel lane in each direction 
(east and west), separating the east and west bound lanes by a median, 
improving inside and outside widths, and providing left-turn 
channelization at all public road intersections within the project 
limits. Safety would also be improved at the State Route 46/41 junction 
by replacing the at grade intersection with a new interchange for the 
connection. The FHWA project reference number is H240 00PE (006). The 
actions by the Federal agencies, and the laws under which such actions 
were taken, are described in the Environmental Assessment (EA)/Finding 
of No Significant Impact (FONSI) for the project, approved on May 19th, 
2006, and in other documents in the FHWA administrative record. The EA/
FONSI, and other documents in the FHWA administrative record file are 
available by contacting the FHWA or the California Department of 
Transportation at the addresses provided above. The FHWA EA/FONSI can 
be reviewed and downloaded from the project Web site at

    The notice applies to all Federal agency decisions as of the 
issuance date of this notice and all laws under which such actions were 
taken, including but not limited to:
