Proposed CERCLA Administrative Settlement; Rosen Brothers 
Superfund Site, Cortland, NY

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice; request for public comment.

SUMMARY: Notice is hereby given of a proposed administrative settlement 
concerning the Rosen Brothers Superfund Site in Cortland, New York with 
the City of Cortland and the New York, Susquehanna and Western Railway 
Corporation. The settlement is a prospective purchaser agreement and it 
requires the settling parties to perform certain response actions, 
including operation and maintenance of a portion of the final cleanup 
remedy following the purchase of the real property. The settlement 
includes a covenant not to sue the settling parties pursuant to 
sections 106 and 107 of CERCLA, 42 U.S.C. 9606 and 9607. For thirty 
(30) days following the date of publication of this document, the 
Agency will receive written comments relating to the settlement. The 
Agency will consider all comments received and may modify or withdraw 
its consent to the settlement if comments received disclose facts or 
considerations which indicate that the settlement is inappropriate, 
improper, or inadequate.

DATES: Comments must be submitted on or before March 3, 1999.
