Herbert H. Tate, Jr.

Biography

Herbert H. Tate, Jr. was confirmed November 22 by the U.S. Senate as Assistant Administrator for Enforcement of the Environmental Protection Agency. President Bush nominated Tate in September. As Assistant Administrator for Enforcement, Tate will be responsible for both the civil and criminal enforcement programs for EPA.

"Herbert Tate brings to EPA the experience necessary to continue and improve the Agency's already tremendously successful enforcement program," said William K. Reilly, EPA Administrator. "There is no higher priority for the Bush Administration, as reflected in the record levels of the past two years."

Prior to his EPA nomination, Tate was County Prosecutor for Essex County, N.J. That office handles over 45,000 criminal cases per year. Tate administered the largest prosecutor's office in the State of New Jersey, managing nearly 430 employees, including over 130 attorneys and 170 investigators.

He had a private practice between May 1985 and August of 1986 where he specialized in Federal and State criminal defense.

From October 1983 to May 1985, Tate served as associate attorney for Carella, Byrne & Gilfillian of Roseland, N.J., focusing on environmental, commercial, and criminal law.

Tate served as Assistant Prosecutor of the Office of the County Prosecutor, Trial Section, in Essex County, N.J., from August 1979 to October 1983.

In addition, Tate clerked for Essex County Superior Court Judge, Van Y. Clinton and served as investigator/field representative for the child abuse program in the office of the Public Defender/Public Advocate for the State of New Jersey.

Tate was born in Karachi, Pakistan, where his father served as U.S. cultural attache. He received his law degree from Rutgers University School of Law, Newark, N.J., and his bachelor of arts degree cum laude in history from Wesleyan University in Middletown, Conn.
