ðLLC€Propertyðð),Ïthe€stormwater€surface€runoff€from€which€has€historically€drained€in€the€form€of€sheet€runoff€onto€andÏacross€portions€of€two€parcels€of€land€in€the€N/2€of€said€Section€13€owned€by€the€Town€and€Ô_ÔNFPÔ_Ô;ÏandÌÌà  àWHEREAS,€the€District€proposes€to€dispose€of€the€post„development€stormwater€runoffÏexpected€to€occur€on€the€LLC€Property€through€sheet€runoff€from€certain€developed€lots€on€theÏnorthern€portion€of€the€LLC€Property€and€in€and€through€a€storm€drainage€system,€and€to€dischargeÏthe€concentrated€storm€runoff€from€the€drainage€system€onto€and€across€portions€of€two€parcels€ofÏland€in€the€N/2€of€said€Section€13€owned€by€the€Town€and€Ô_ÔNFPÔ_Ô€and€then€into€the€Ô_ÔABCDÔ_Ô€Ditch€andÏthe€Ô_ÔXXXXÔ_Ô€Reservoir€(the€ð ðReservoirðð),€which€are€owned€and€operated€respectively€by€DRC2€andÏDRC1€for€the€carriage€and€storage€of€water€belonging€to€their€shareholders€and€which€Reservoir€hasÏbeen€classified€by€the€Colorado€Water€Quality€Control€Commission€as€a€Class€1€Recreational,€ClassÏ1€Warm€Water€Aquatic€and€Agricultural€Water;€andÌÌà ðWater€Quality€Control€Facilityðð)€on€that€portionÏof€the€property€of€the€Town€and€Ô_ÔNFPÔ_Ô€located€between€the€boundary€line€fenceÏand€the€line€of€the€Ô_ÔABCDÔ_Ô€Ditch€or€the€shore€of€the€Reservoir.€€The€final€designÏand€specifications€of€the€Detention€Ponds€and€the€Water€Quality€ControlÏFacility€are€attached€as€Exhibit€ð ðCðð.€€By€their€execution€of€this€Agreement,€theÏTown,€Ô_ÔNFP,Ô_Ô€and€Ô_ÔDRC1,Ô_Ô€hereby€approve€of,€and€consent€to€the€construction€ofÏthe€Detention€Ponds€and€the€Water€Quality€Control€Facility€in€accordance€withÏExhibit€ð ðCðð.€€Upon€24„hour€written€notice€to€the€District,€Ô_ÔNFPÔ_Ô€and€Ô_ÔDRC1Ô_Ô€shallÏhave€the€right€to€inspect€the€construction€of€the€Detention€Ponds€and€the€WaterÏQuality€Control€Facility€to€assure€compliance€with€the€design€specifications.€ÏOnce€constructed,€the€facility€shall€be€operated,€maintained,€rehabilitated,Ïreplaced€or€upgraded€to€assure€that€it€will€function€in€accordance€with€theÏcriteria,€terms€and€conditions,€including€the€remedies€hereinafter€set€forth€inÏparagraph€no.€3.Ð ЇÌReservoir€uses€existing€as€of€the€date€of€this€Agreement,€or€cause€the€Reservoir€to€exceed€theÏnarrative€and€numeric€Water€Quality€Standards€adopted€by€the€Colorado€Water€Quality€ControlÏCommission€applicable€to€the€Reservoir,€as€they€may€be€revised€from€time€to€time.€€As€a€conditionÏof€invoking€remedies€under€this€Agreement€to€address€a€claimed€breach€by€the€District€ofÏnarrative€or€numeric€Reservoir€ambient€water€quality€standards€or€of€any€claimed€impairment€ofÏReservoir€uses,€it€shall€be€the€burden€of€the€Town,€Ô_ÔNFP,Ô_Ô€and/or€Ô_ÔDRC1Ô_Ô€to:€establish€and€implementÏa€water€quality€sampling€and€laboratory€analyses€program€for€the€Reservoir€adequate€toÏaccurately€identify€baseline€water€quality€conditions€in€the€Reservoir€as€of€the€date€of€thisÏAgreement€and€to€accurately€monitor€changes€in€Reservoir€water€quality,€for€the€parameters€forÏwhich€the€District€is€required€to€test€under€this€Agreement;€deliver€to€the€District€copies€of€allÏsampling€protocol€and€laboratory€water€quality€analyses€for€the€Reservoir;€and€show€the€extent€toÏwhich€the€total€contribution€of€constituent€loading€by€the€District,€when€compared€with€the€totalÏcontribution€of€such€constituents€from€other€sources€for€the€same€time€period€or€stormwaterÏevent,€or€the€extent€to€which€the€acute€concentration€of€such€constituents€contributed€by€theÏDistrict,€when€compared€with€the€acute€concentrations€thereof€contributed€from€other€sources€forÏthe€same€time€period€or€stormwater€event,€has€caused€an€impairment€of€the€existing€uses€of€theÏReservoir€or€violation€of€the€water€quality€standards€applicable€to€the€Reservoir.€€Such€proof€shallÏinclude€a€demonstration€that€reducing€the€contribution€of€contaminants€in€the€stormwater€from€theÏÔ_ÔLLCÔ_Ô€property€will€remediate€in€whole€or€in€part,€the€claimed€impairment€of€existing€ReservoirÏuses€or€violation€of€Reservoir€water€quality€standards.€€The€current€set€of€water€quality€standardsÏapplicable€to€the€Reservoir€is€set€forth€on€Exhibit€ð
