ƒ#ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€Ô‡XÃÑXX X,%Ô€Ô#† X,%XXXÃÑ"#ÔIn€order€to€meet€these€sulfur€inÐ ¢^ Ðgasoline€requirements,€some€refiners€will€have€to€makeÏmodifications€to€their€existing€facilities.€€EPA€further€believesÏthat€in€certain€of€these€cases€these€modifications€will€beÏsubject€to€the€major€new€source€review€(NSR)€preconstructionÏpermitting€requirements€under€parts€C€and€D€of€the€Clean€Air€Act.€ÏThe€refiners€subject€to€major€NSR€will€be€required€to€undergo€aÏpollution€control€technology€evaluation€to€apply€either€BACT€orÏLAER,€depending€on€the€applicable€program€requirements.€ÌÐ àAfter€a€review€of€the€available€information,€it€is€EPAððsÏconclusion€that€for€NOx€emissions,€€a€combination€of€SelectiveÏCatalytic€Reduction€(SCR)€and€Ultra„low€NOX€burners€representsÏBACT€for€new€process€heaters€at€refineries€capable€of€firing€50ÏMMBTU€or€greater€of€refinery€or€natural€gas.€€The€combination€ofÏcontrols€represents€the€best€level€of€control€that€can€beÏachieved€and€would€be€expected€to€result€in€an€overall€NOxÏreduction€of€upwards€of€97%€from€uncontrolled€levels.€The€averageÏand€incremental€costs€are€acceptable€and€there€are€no€adverseÏenvironmental€or€economic€impacts€associated€with€the€controlÏstrategy€that€would€indicate€that€a€less€stringent€options€shouldÏbe€considered.€Consequently,€EPA€believes€this€control€strategyÐ  ,È$, Ðis€BACT€for€such€units.€€ÌÌà  àAt€this€time€the€combination€of€SCR€and€Ultra„low€NOXÏburners€represents€the€most€stringent€control€level€achieved€orÏcontained€in€a€SIP.€€As€a€result,€it€also€represents€LAER€forÏthose€units.€€ÌÌà  àEPA€expects€that€refineries€will€likely€be€able€to€avoid€theÏapplication€of€major€NSR€to€individual€or€multiple€new€refineryÏprocess€heaters€of€less€that€50€MMBTU€by€controlling€emissions€toÏlevels€well€below€the€applicable€significance€level€for€a€majorÏmodification€(e.g.,€40€tons€per€year€for€PSD).€€Consequently,€weÏdo€not€believe€it€is€appropriate€to€provide€a€position€on€BACTÏfor€these€units€at€this€time.€€Should€the€need€arise€for€federalÏguidance€on€BACT€for€these€refinery€process€heaters€within€theÏcontext€of€permitting€€refinery€gasoline€desulfurization,€we€willÏconsider€issuing€supplemental€guidance€at€that€time.€€ÌÌÌòòBACT€and€LAER€for€VOC€emissions€from€Refinery€EquipmentóóÐ
