June 19, 1980 PSD and NSPS Applicability Determination for Guardian Industries' Flat Glass Plant in Corsicana, Texas 1.8In order to be grandfathered under the June 19, 1978 PSD regulations, in relation to the Guardian Industries Flat Grass Plant, the source must have:
- Received all the necessary SIP preconstruction permits by March 1, 1979 and have met one of the following:
- Begun a continuous program of offsite
- Entered into binding agreements for on-site construction which cannot be canceled without substantial loss.
The guardian did not meet the requirements under 1. Substantial loss is determined on a case-by-case basis. An"irrevocable commitment" is also assessed on a case-by- case basis, depending on whether contracts or binding agreements for off-site construction have been entered into for a source which can only be located at a specific site.
