Earlier Federal Stormwater Management Requirements

The following federal requirements show the evolution of federal green buildings and stormwater management requirements but do not contain any requirements additional to the ones described in Federal Stormwater Management Requirements:

Executive Order 13423

Executive Order (EO) 13423, issued in January 2007, converted provisions of the Federal Leadership in High Performance and Sustainable Buildings Memorandum of Understanding (MOU) into an executive order. Section 2 (f)(i) required federal agencies to ensure new construction and major renovation of agency buildings comply with the Guiding Principles for Federal Leadership in High Performance and Sustainable Buildings set forth in the MOU. Section 2(f)(ii) added a requirement to incorporate the sustainable practices in the Guiding Principles in at least 15 percent of their existing building inventories by the end of fiscal year (FY) 2015.

Federal Leadership in High Performance and Sustainable Buildings MOU

In January 2006, EPA signed an MOU with 16 other federal agencies to promote high performance and sustainable buildings and to create the Guiding Principles for Federal Leadership in High Performance and Sustainable Buildings, which applied to new construction and renovations. The MOU was a predecessor to the high performance green buildings provisions of EO 13423.

The original Guiding Principles for Federal Leadership in High Performance and Sustainable Buildings adopted with the MOU, which incorporate requirements from the Energy Independence and Security Act of 2007 (EISA), require agencies to employ design and construction strategies that reduce stormwater runoff, polluted site water runoff, and the use of potable water for irrigation. They promote the use of decentralized stormwater management design strategies to maintain or restore site hydrology to pre-development conditions and promote water-efficient landscaping and irrigation strategies.

On December 1, 2008, following the signing of EO 13423, the Interagency Sustainability Working Group released a High Performance and Sustainable Buildings Guidance document that updated the MOU's Guiding Principles for Federal Leadership in High Performance and Sustainable Buildings, which apply to new construction and major renovations, and established the Guiding Principles for Sustainable Existing Buildings to apply to existing buildings.
