ORDER DENYING MOTION FOR ACCELERATED DECISION
Complainant's Motion for Accelerated Decision dated May 7, 1997, is denied as untimely.
The hearing in this matter is scheduled to begin on June 4, 1997. There is not enough time, under the EPA Rules of Practice, to allow for a response from Respondent and a decision by the
Administrative Law Judge in advance of the hearing. (See 40 CFR §§22.07, 22.16).
The parties are encouraged, however, to reach stipulations to undisputed facts in order to narrow
the issues for hearing. The parties will be advised of additional hearing procedures when the
arrangements for the hearing location are confirmed by the Regional Hearing Clerk.
