The Request for Proposal PR-HQ-09-10898 was released today. In addition, technical questions for this solicitation must be submitted no later than May 16, 2009 at 5:00 p.m. EDT. Questions may be submitted via e-mail to the point of contact indicated at the bottom of the page. Furthermore, the first sentence of the synopsis has been revised to read as follows:

"The U.S. Environmental Protection Agency (US EPA) Office of Enforcement and Compliance Assurance (OECA), Office of Civil Enforcement (OCE) anticipates awarding up to two, five year (two-year base period, a two-year option, and a one-year option), level of effort, cost-reimbursement type contracts; each ordering an equal level of effort."

The U.S. Environmental Protection Agency (US EPA) Office of Enforcement and Compliance Assurance (OECA), Office of Civil Enforcement (OCE) anticipates awarding two, five year (2 year base period, a two-year option, and a one-year option), level of effort, cost-reimbursement type contracts, for 60% and 40% of the total hours. The North American Industry Classification System (NAICS) code for this effort is 541620. The small business size standard for this NAICS category is $7.0 million in annual receipts (or income). This procurement will be conducted under Federal Acquisition Regulation (FAR) Part 15: Contracting by Negotiation.

The formal solicitation and other related information and items will be posted at this web address on or about March 6, 2009 . Proposals will be due thirty days from the posting date. The total labor hour estimate for this effort is approximately 270,000 hours, including all options. All responsible offerors may submit a proposal. Copies of the solicitation will be available at this site. Paper copies of the solicitation will not be provided.

The purpose of this procurement is to provide technical, analytical, and enforcement support for OECA's Office of Civil Enforcement (OCE). OCE is charged with implementing the Agency Regulatory Enforcement Programs. Under these authorities, OCE is responsible for the development, litigation, and settlement of administrative and civil judicial cases against violators of various environmental laws. The purpose of this requirement is to assist OCE in the following work areas: enforcement program implementation, enforcement case support leading to litigation, compliance monitoring, facilities inspections, laboratory support, and specialized activities; program and management analysis, program development, information management, outreach, and pollution prevention; and records management.

The resultant contract for this effort will contain a Limitation of Future Contracting (LOFC) clause; stipulating that: During the life of the contract, and for a period of five (5) years after the completion of the contract, unless prior written approval is obtained from the cognizant EPA Contracting Officer, the Contractor shall not enter into a contract: (1) with owners or operators of facilities that may be impacted by enforcement and compliance activities performed under a Work Assignment, of the resultant contract, as regulated parties under the Clean Water Act (CWA); Safe Drinking Water Act (SDWA); Marine Protection, Research and Sanctuary Act (MPRSA); Clean Air Act ( CAA ); Resource Conservation and Recovery Act (RCRA); Oil Pollution Act (OPA); Pollution Prevention Act (PPA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Superfund Reauthorization and Amendments Act (SARA); Toxic Substance Control Act (TSCA); Federal Facility Compliance Act (FFCA); National Environmental Policy Act (NEPA); Emergency Planning and Right-to-Know Act (EPCRA); Comprehensive Environmental Response, Compensation and Liability Act (CERCLA); Asbestos Hazard Emergency Response Act (AHERA); and Mercury-Containing and Rechargeable Battery Management Act (Battery Act); or (2) to act as a consultant to any such regulated parties that may be impacted by enforcement and compliance activities performed under a Work Assignment, of the resultant contract.
