NAICS Code: 334516 - The U.S. Environmental Protection Agency (EPA) National Enforcement Investigation Center (NEIC) intends to award a sole source firm-fixed-price Purchase Order under the authority of Federal Acquisition Regulation (FAR) part 13, Simplified Acquisition Procedures, to Rigaku Americas Corporation for services on a X-ray spectrometer mod ZSX-101E, SN: XR03004. The period of performance of this order will be from 9/1/10 – 8/31/11. Rigaku Americas Corporation is the only known source for providing service and maintenance of this equipment as it is a complex instrument and requires attention from highly skilled engineers. Only Rigaku is trained and experienced in providing preventative maintenance to this type of equipment and for fixing malfunctions. The Rigaku service engineers are the only service engineers who have access to the service manuals, service knowledge and spare parts required to keep the X-Ray spectrometer functioning properly.

NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE FOR THIS PROCUREMENT. Notwithstanding, any firm that believes it is capable of meeting EPA's requirement as stated herein may submit a capability statement, which if received within fifteen (15) calendar days of the date of this announcement will be considered. Responses to this posting must be in writing and provide clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
