NAICS Code: 811219 - The U.S. Environmental Protection Agency (EPA) National Enforcement Investigations Center (NEIC) intends to award a sole source fixed-price purchase order under the authority of Federal Acquisition Regulation (FAR) part 13, Simplified Acquisition Procedures to PANalytical, Inc. for a one-year maintenance contract for a PANalytical Epsilon 5 X-Ray Spectrometer housed in Denver, CO. The maintenance contract will begin on June 10, 2012 and go through June 9, 2013.
NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE FOR THIS PROCUREMENT. It has been determined that PANalytical is uniquely qualified to satisfy the Government’s requirements, as they have been the sole provider of maintenance and upgrades to the PANalytical spectrometer manufactured by the same company. In an effort to maintain continuity of services with currently standing equipment PANalytical is the only company able to meet the service requirements of the NEIC. The selected contractor must maintain the PANalytical XRF spectrometer in good, operable condition. The selected contractor also must provide unlimited emergency service visits and two preventative maintenance visits per year. The contractor must all include all parts, labor, travel and living expenses required under this order. Notwithstanding, any firm that believes it is capable of meeting EPA’s requirement as stated herein may submit a capability statement, which if received by the response date of this announcement must provide evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
