Notice of Intent to Award a Sole Source Purchase Order for TopBraid Live Developer License

The U.S. Environmental Protection Agency's Office of Acquisition Management, Information Resource Management Procurement Service Center (IRMPSC) intends to issue a sole source GSA purchase order to TopQuadrant, Inc., 330 John Carlyle Street, Suite 180, Alexandria, VA 22314-5760 on behalf of the Office of Research and Development. This requirement is to provide an enterprise-wide developer license for TopBraid Live, and a 1-year option period for technical support and maintenance services for the developer license of TopBraid Live. The estimated value of this procurement is approximately $20,150.00 total. Under the authority of FAR 8.405-6(a)(1)(i)(B) and 8.405-6(b), only the developer of the software, TopQuadrant, Inc., is capable of supplying the license and the software is the only software that will satisfy Agency requirements. In addition, there are no authorized distributors for this software. The period of performance for this requirement must commence 5 days from date of award. The North American Industry Classification System (NAICS) Code for this procurement is 511210 and the Product Service Code (PSC) is 7030.
NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE FOR THIS PROCUREMENT. Notwithstanding, any firm that believes it is capable of meeting EPA’s requirement as stated herein may submit a capability statement, which if received by 5:00 PM EST on Saturday, August 4th, 2012 will be evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government. All questions or comments regarding this procurement shall be addressed in writing to Brent Maravilla, at maravilla.brent@epa.gov. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. No telephone calls will be accepted.
