Intent to Sole Source to LECO Corporation for Annual Full Service Agreement for Pegasus 4D TOF
The U.S. Environmental Protection Agency (EPA) National Enforcement Investigations Center (NEIC), under the authority of the Federal Acquisition Rules (FAR) Part 13, Simplified Acquisition Procedures, intends to issue a sole source purchase order to LECO Corporation for an annual full service agreement for a Pegasus 4D TOF.
The justification is as follows. LECO is the only provider with the combination of knowledge, hardware, software, available spare parts supply and the technical expertise capable of providing service for this instrument. LECO has service engineers who are factory trained by LECO for this GC X GC TOF/MS system to maintain their level of service and no one else has access to this training to perform the requested service. LECO has proprietary information and manuals that only LECO personnel have access to and its engineers are familiar and capable of servicing this instrument. The Pegasus GC X GC TOF/MS is built with a significant amount of proprietary components that can only be purchased through LECO. This laboratory equipment has proprietary software and software releases specific to LECO are provided by the original equipment manufacturer LECO to customers who have a service agreement in place.
NO SOLICITATION OR REQUEST FOR QUOTE IS AVAILABLE. Notwithstanding, any firm who believes it is capable of meeting EPA's requirement as stated herein may submit a response, which if received within (5) calendar days of the date of this announcement, will be considered. Responses to this posting must be in writing. A determination not to compete the proposed Purchase Order based upon the responses is solely within the discretion of the Government.
