In accordance with FAR 13.106-1(b)(1), the U.S. EPA National Enforcement Investigations Center (NEIC) intends to issue a sole source purchase order to Petroleum Analyzer Company LP of Houston, TX. The purchase order is for a Hertzog Model 339 Pensky-Martens flash point test apparatus and related accessories. The unit is necessary for determining if samples will be ignitable under the regulatory definition given in 40 CFR 261.21.
The justification is as follows. The requirements for testing liquid ignitables are given in 40 CFR 261.21. This can be satisfied by either of two test methods as given by ASTM. One of these, ASTM D93-79/80, utilizes the Pensky-Martens (PM) flash point test apparatus and specifies its conformity requirements therein. Only a Hertzog model meets the requirements given under Annex A1 of the required procedure given in either ASTM D93-79 or 80 and the Hertzog 339 model meets the EPA's minimum requirements.
THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The decision not to compete this requirement is within the discretion of the government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
