The US Environmental Protection Agency (EPA), Office of Acquisition Management (OAM) on behalf of the Office of Chemical Safety and Pollution Prevention (OCSPP), Office of Pesticide Programs (OPP) has awarded a Firm-Fixed Price purchase order (EP-13H-000575) with limited competition to Kline & Company, for Specialty Market Pesticide Data. The purchase order was awarded for a 1-year period beginning October 21, 2013, for a total cost of $172,000.00. The justification for other than full and open competition is posted below.

Notice of Intent to Award a Sole Source Purchase Order to Kline & Company, Inc.
NAICS Code: 511140. The US Environmental Protection Agency (EPA) Office of Acquisition Management (OAM) intends to award a sole source purchase order for the Office of Pesticide Programs (OPP) Biological and Economic Analysis Division (BEAD) under the authority of FAR Part 13.501(a) to Kline & Company (K&C) for Specialty Market Pesticide Data. The EPA requires a database with contains accurate, current usage data for non-agriculturally used pesticides by chemical end-use product, site treated, as well as possible proximity to human contract and the qualities of pesticidal active ingredients applied.
NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE FOR THIS PROCUREMENT. It has been determined that K&C is the only source for this data that meets the Government's requirements. Notwithstanding, any firm that believes it is capable of meeting EPA's requirement as stated herein, may submit its capability by 12:00 PM on Wednesday, October 2, 2013, which may be considered by the Government. A determination not to compete the purchase order based upon the responses to this notice is solely within the discretion of the Government. This is a combined synopsis/solicitation for services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and an additional written solicitation will not be issued.

The applicable NAICS code is 511140. It is the Government's intent to award a Purchase Order by October 2, 2013 for the requirement below:
The Environmental Protection Agency's Biological and Economic Analysis Division (BEAD) requires a database which contains accurate, current usage data for non-agriculturally used pesticides by chemical end-use products, site treated, as well as possible proximity to human contact and the qualities of pesticidal active ingredients applied. This information will serve as critical input for the Agency to conduct economic and related analysis of pesticide regulatory matters.

The response shall be delivered within 14 days of award of a purchase order in an electronic format. The electronic documents shall be Section 508 Compliant ( http://www.access-board.gov ).
The provisions at 52.212-1, Instructions to Offerors-Commercial; 52.212-3, Offeror Representations and Certifications – Commercial Items; 52.212-4, Contract Terms and Conditions-Commercial Items; and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items apply to this acquisition.
