Bicycloheptene Dicarboximide (MGK-264) Reregistration Eligibility Decision
Available for Comment
EPA has released its Reregistration Eligibility Decision for the pesticide
N-Octyl bicycloheptene dicarboximide (MGK-264) and has opened a public
comment period on this document. The Agency's risk assessments and other
related documents also are available in the MGK-264 docket. MGK-264 is
a pesticide active ingredient that acts as a synergist. Its uses include
application to non-food plants, applications in food and non-food handling
commercial and agricultural structures and outdoor premises, housing for
veterinary and farm animals, and direct application to veterinary and
non-food animals. Comments, identified by docket ID number EPA-HQ-OPP-2005-0040,
must be received on or before October 24, 2006.

Invited on Piperonyl Butoxide (PBO) Reregistration Eligibility Decision
EPA has released its Reregistration Eligibility Decision for
the pesticide piperonyl butoxide (PBO) and has opened a public comment
period on this document. The Agency's risk assessments and other related
documents also are available in the piperonyl butoxide docket. PBO is
a pesticide active ingredient that acts as a synergist. It is used for
preharvest and postharvest application on many agricultural crops; direct
and indirect treatments of livestock animals and premises; treatment of
areas where raw and processed food/feed commodities are stored or processed;
and in mosquito abatement areas. Comments, identified by docket ID number
EPA-HQ-OPP-2005-0042, must be received on or before October 24, 2006.
Propanil
Reregistration Eligibility Decision Amended
The comment period for the propanil Reregistration Eligibility Decision
(RED) has ended. EPA has released an amendment to the document as a result
of its review of the public comments and additional data submitted by
the propanil task force. The revisions include label changes and an updated
Appendix B: Data Supporting Guideline Requirements for the Reregistration
of Propanil. The label changes related to dry flowable closed systems
are contingent on the outcome of exposure data due in December 2006. EPA
considers both the RED and the amendment to be final decisions.
Pyrethrins
Reregistration Eligibility Decision Available for Comment
EPA has released its Reregistration Eligibility Decision for
the pyrethrin pesticides and has opened a public comment period on this
document. The Agency's risk assessments and other related documents also
are available in the pyrethrins docket. Pyrethrins are botanical insecticides
derived from the flowers of Chrysanthemum cinerariaefolium. Pyrethrins
are used for pre-harvest and post-harvest application on many agricultural
crops; direct and indirect treatments of livestock animals and premises;
treatments of areas where raw and processed food/feed commodities are
stored or processed; and in wide-area mosquito abatement programs. Comments,
identified by docket ID number EPA-HQ-OPP-2005-0043, must be received
on or before October 24, 2006.

Invites Comments on Resmethrin Reregistration Eligibility Decision
EPA has released its Reregistration Eligibility Decision for
the pesticide resmethrin and has opened a public comment period on this
document. The Agency's risk assessments and other related documents also
are available in the resmethrin docket. Resmethrin is a synthetic Type
I pyrethroid insecticide registered for control of insects in residential,
commercial, and industrial settings, in animal living areas, and in food
handling establishments. Resmethrin is also registered as a restricted-use
pesticide when used to control adult mosquitoes in the interest of public
health. Comments, identified by docket ID number EPA-HQ-OPP-2005-0284,
must be received on or before October 24, 2006.

Holds Public Meeting in Iowa on Proposed Rule for Large Feedlots
EPA held a public meeting in Ames, Iowa, on July 25,
2006, to enhance understanding of a proposed EPA rule to control effluent
from concentrated animal feeding operations (CAFOs), such as large pig,
veal, poultry, beef, and dairy farms. EPA experts gave a presentation
and answered questions on the proposed rule, under which CAFOs would continue
to be required to properly manage the manure they generate. EPA proposed
the rule June 22, 2006. Comments are due for this proposed rule by August
14, 2006. This was one of five meetings scheduled nationally on this topic;
the next meeting will be Tuesday, August 1, 2006, in Golden, Colorado.

on Benefits of Watershed-Based NPDES Permitting
EPA's Watershed Academy hosted a free Webcast seminar on
July 19 entitled Benefits of Watershed-Based National Pollutant Discharge
Elimination System (NPDES) Permitting, featuring Patrick Bradley and Jennifer
Molloy from EPA's Office of Wastewater Management. This interactive on-line
seminar covered mechanisms to implement watershed-based permitting and
issues related to managing storm water and other wet weather impacts.
DCNA
Reregistration Eligibility Decision Available
EPA has released its Reregistration Eligibility Decision (RED)
for the pesticide DCNA (Dicloran), and has opened a public comment period
on this document. The Agency's risk assessments and other related documents
also are available in the DCNA (2,6- dichloro-4-nitroaniline) Docket.
DCNA, also referred to as Dicloran, is a fungicide used to control pathogenic
species such as Botrytis, Monilinia, Rhizopus, Sclerotinia and Sclerotium.
DCNA is registered for agriculture and horticulture uses. Its registered
formulations include dusts, wettable powders, and flowable concentrates.
These products can be applied using aerial, airblast, groundboom, chemigation,
and hand-application methods. Comments, identified by docket ID number
EPA-HQ-OPP-2005-0265, must be received on or before August 18, 2006.

Cites Two Suffolk County Firms for Selling Off-Spec, Misbranded Pesticides
A pesticide producer and a telemarketer/distributor in Suffolk
County, New York have been cited by EPA for multiple violations of the
federal pesticide law. EPA is seeking financial penalties totaling nearly
$1.5 million in separate complaints against the Topaz Turf Corporation
in Holtsville and Southern Chemical Supply, Inc. in Bohemia, which used
Topaz as its supplier. EPA is alleging the companies distributed off-spec
and misbranded pesticides to the public since at least October 2003. In
addition, the agency charged Topaz with selling an unregistered pesticide
(to kill insects on plants) and failing to maintain and furnish production
records. EPA also alleges that Southern made misstatements in the sale
of the pesticides.

Accepting Applications for Water Efficiency Leader (WEL) Awards
EPA has created a new awards program designed to recognize
organizations and individuals who are providing leadership and innovation
in water-efficient products and practices. Recognition will be given on
the basis of persuasive community or organizational leadership in the
area of water efficiency, originality and public purpose, global perspective
and implications, and overall improvements in water efficiency. Award
recipients gain national recognition for accomplishments and the opportunity
to share case studies and best practices with other leaders. The application
deadline is August 4, 2006. (This is an extension of the deadline stated
in the Federal Register notice.)

EPA
Settles With Southern California Pesticide Company for $5,850
EPA has settled for $5,850 with California Pool and Chemical
Service of Artesia, Calif., for failing to submit their 2005 pesticide
production report on time, a violation of the federal pesticide law. The
company, which produces sodium hypochlorite for swimming pool disinfection,
was subject to an EPA action last year due to similar violations.
Innovation
in Wood Stove Changeouts Study
This notice announces the availability of funds and solicits proposals
that demonstrate innovative approaches to developing and supporting wood
stove changeout programs across the country. The total estimated funding
for this competitive opportunity is $300,000. EPA anticipates award of
one to three cooperative agreements resulting from this announcement,
subject to the availability of funds and the quality of applications received,
ranging in value from $100,000 to $300,000. The closing date for receipt
of proposals under this RFP is August 21, 2006, 4:00 p.m. EDT. All proposals,
however submitted, must be received by the closing date and time to receive
consideration. No late proposals will be accepted.

National
Carcass Disposal Symposium 2006 ![]()
The National Carcass Disposal Symposium will take place December
4th through 7th, 2006. There will be a pre-symposium workshop dealing
with euthanasia & decontamination on December 4th at USDA-ARS in Beltsville,
MD. The symposium will occur on December 5th through 7th, 2006 at the
University of Maryland Conference Center. There will also be a half day
post symposium demonstration on December 7, 2006 at Beltsville, MD. This
will be a demonstration of available carcass disposal technology. The
topics will include: research and public policy on carcass disposal in
response to routine mortalities, natural disasters, and disease outbreaks;
new & emerging carcass disposal technologies; carcass treatment options;
final product disposition; public policy on disposal of wildlife, marine
mammals, and agricultural mortalities; and state and agency response and
training experiences.

Reregistration Eligibility Decision Available for Comment
EPA has released its Reregistration Eligibility Decision (RED)
for the pesticide dicamba acid and its associated salts, and has opened
a public comment period on this document. The Agency's risk assessments
and other related documents also are available in the dicamba Docket.
Dicamba (2-methoxy-3,6-dichlorobenzoic acid) is a selective benzoic acid
herbicide registered for pre-emergent control of broadleaf weeds and woody
plants. Comments, identified by docket ID number EPA-HQ-OPP-2005-0479,
must be received on or before September 12, 2006.

Publishes Annual Pesticide Reregistration Performance Measures and Goals
Report
As required by the amended Federal Insecticide, Fungicide, and
Rodenticide Act (FIFRA), EPA publishes information annually describing
its progress in meeting performance measures and goals for pesticide reregistration
and tolerance reassessment. The Agency's annual report on accomplishments
during FY 2005 was published in the Federal Register on Friday, June 23,
2006. The measures and goals include the status of reregistration, product
reregistration, and tolerance reassessment. The notice gives numbers of
pesticides and products reregistered, tolerances reassessed, data call-in
notices issued, studies reviewed in support of reregistration, and products
registered under the "fast track" provisions of FIFRA. The notice
also contains the Agency's schedule for completing specific pesticide
decisions during subsequent fiscal years.

Region 5 Steps Up Pesticide Export Oversight
EPA Region 5 has increased oversight of pesticide exporters
over the past two-and-a-half years. During that time, $440,000 in penalties
were assessed against seven companies for violations. The violators failed
to take one or more of these required steps:
- Translate portions of pesticide labels into the predominant language of the country of import
- Export registered products with proper labeling and translation
- Obtain written acknowledgement from foreign customers verifying that they understand the products were not registered in the United States.

Dimethoate
Interim Reregistration Eligibility Decision
EPA has released its Interim Reregistration Eligibility Decision
(IRED) for the organophosphate pesticide dimethoate, and has opened a
public comment period on this document. The Agency's risk assessments
and other related documents also are available in the dimethoate docket.
Dimethoate is a systemic organophosphate insecticide used for control
of a wide variety of insect pests on a number of fruit, vegetable, grain,
and field crops, as well as ornamentals and non-cropland adjacent to agricultural
fields. Comments, identified by docket ID number EPA-HQ-OPP-2006-0084,
must be received on or before September 11, 2006.

Mesa,
Ariz. Company Pays $24,400 Fine for Pesticide Violations
EPA fined a Mesa, Ariz. company $24,400 for violating federal
pesticide law. Water & Energy Systems Technology, Inc. allegedly sold
its pesticide, C124, with a composition that differed from the composition
described in the registration for this pesticide. The company also allegedly
continued to sell or distribute pesticide C1204 after its registration
had been canceled. Both products are used to control algae in recirculating
cooling water.

Invited on Proposal for 2007 Critical Use Exemption From Phaseout of Methyl
Bromide
EPA is proposing an exemption to the phaseout of methyl bromide to meet
the needs of 2007 critical uses. The Agency is proposing uses that will
qualify for the 2007 critical use exemption and the amount of methyl bromide
that may be produced, imported, or supplied from stocks for those uses
in 2007. EPA is seeking comment on the list of critical uses and on EPA's
determination of the amounts of methyl bromide needed to satisfy those

and Poultry Environmental (LPE) Learning Center ![]()
The Livestock and Poultry Environmental (LPE) Learning Center is is a
project dedicated to the vision that individuals involved in public policy
issues, animal production, and delivery of technical services for confined
animal systems should have on-demand access to the nation's best science-based
resources. The center will be responsive to priority and emerging environmental
issues associated with animal agriculture.
Imazapyr
Reregistration Eligibility Decision
EPA has released its Reregistration Eligibility Decision
(RED) for the pesticide imazapyr. The Agency's risk assessments and other
related documents also are available in the imazapyr docket. Imazapyr
is a systemic, nonselective, pre- and post-emergent herbicide used for
the control of terrestrial annual and perennial grasses, broad-leaved
herbs, woody species, and riparian and emergent aquatic species. Imazapyr
was reviewed through the modified four-phase public participation process.
Since all risk issues associated with the use of this pesticide were resolved
through consultations with stakeholders, the Agency is issuing the imazapyr
RED without an additional comment period.

Sets Public Meetings on Proposed NPDES Revisions for CAFOs
Between July 24 and August 3, EPA will conduct five public meetings on
proposed regulatory revisions for Concentrated Animal Feeding Operations
(CAFOs). These proposed regulations under the Clean Water Act were signed
by EPA Administrator Stephen L. Johnson on June 22, 2006, and were published
in the Federal Register on June 30 (FRL 8189-7). Meeting sites include
Washington, DC; Fayetteville, North Carolina; Ames, Iowa; Golden, Colorado;
Dallas, Texas; and Sacramento, California.
