FOIA Requests

What are the Freedom of Information Act (FOIA) and the Privacy Act (PA)?

The Freedom of Information Act (FOIA) provides that any person has a right to obtain access to Federal agency records, except to the extent that such records are protected from public disclosure by one of nine exemptions. The Privacy Act (PA) provides access to one of ten nondisclosure documents except for those protected by the exemptions. The PA protects from disclosure all personal identifiable records in the Government’s possession, with certain exceptions established by statute.

Who can file a FOIA or PA request?

Anyone can file a FOIA request. Any citizen or lawfully-admitted alien can file a PA request. Either type of request must be made in writing or submitted in an electronic format. The EPA OIG does not accept requests by phone.

How long does it take to get a response under FOIA?

Once an agency receives a FOIA request, the agency has 20 working days to make a decision on the request.

How can you file a FOIA and PA request with the EPA?


1. FOIAonline (Preferred / Fastest Method)

FOIAonline allows you to electronically submit FOIA requests, modify requests, communicate with the EPA about the status of a request, search previously submitted requests, view responsive documents that are cleared for release, access a dashboard with information about the status of a request, and file an appeal.

Are There Any Fees Associated with a FOIA Request?

Anything costing the OIG less than $25 to process is free; you must pay for any OIG processing costs in excess of that amount. We will contact you if the estimated costs will exceed your authorized amount. In certain limited circumstances, individual requests are entitled to a fee waiver for the costs of processing a FOIA request.

Obtaining FOIA Fee Waivers

In certain limited circumstances, individual requests are entitled to a fee waiver. The following factors must be met:

  1. A clear statement whether subject of the requested records concerns “the operations or activities of the government.”

  2. Whether the disclosure is “likely to contribute” to an understanding of government operations or activities.

  3. The contribution to an understanding of the subject by the public is likely to result from disclosure: Whether disclosure of the requested information will contribute to “public understanding.

  4. The significance of the contribution to public understanding: Whether the disclosure is likely to contribute “significantly” to public understanding of government operations or activities.

  5. The existence and magnitude of a commercial interest: Whether the requester has a commercial interest that would be furthered by the requested disclosure.

  6. The primary interest in disclosure

Expedited Processing

Yes, I am requesting expedited processing.

In certain LIMITED circumstances, individual requests are entitled to be moved ahead of other requests on an expedited basis. The following factors must be met and certified to be true and correct:

  1. Circumstances in which the lack of expedited treatment could reasonably be expected to pose an imminent threat to the life or physical safety of an individual; or
  2. An urgency to inform the public about an actual or alleged Federal government activity, if the information is requested by a person primarily engaged in disseminating information to the public.
