Pesticide News Story: Comment Period Open on NMFS’ Draft Measures to Protect Threatened and Endangered Pacific Salmon

The EPA is seeking comments by May 31, 2013, on draft Reasonable and Prudent Measures (RPMs) and Alternatives (RPAs) included in a draft Biological Opinion that the agency received from the National Marine Fisheries Service (NMFS) on May 1, 2013. This draft Biological Opinion addresses the potential effects from three pesticides to Pacific salmon and steelhead listed as endangered or threatened under the Endangered Species Act. The three pesticides are: propargite, fenbutatin oxide and diflubenzuron.

The EPA encourages input from pesticide users, registrants, public interest organizations and other interested parties, as well as from State, Tribal, and local governments, on the draft RPMs and RPAs. Their comments will help the agency determine whether the alternatives or measures can be reasonably implemented and whether there are different measures that may provide adequate protection but result in less impact to pesticide users.

The draft Biological Opinion is included in docket EPA-HQ-OPP-2008-0654 at Regulations.gov and links to the document will be posted on the EPA’s ESPP website. Comments on the draft RPMs and RPAs must be submitted by May 31, 2013, that is, within about 30 days of the date when the Biological Opinion is included in the docket. No extensions to this comment period will be provided because NMFS has a legal deadline to issue the final Biological Opinion by June 30, 2013. The EPA will forward to NMFS for their consideration all public comments we receive on this draft Biological Opinion. Additionally, the EPA plans to provide NMFS our comments on the draft opinion.
