Updated Notice of Arrival of Pesticides and Devices Form (EPA Form 3540-1)

The EPA has now updated the form for Notice of Arrival (NOA) of Pesticides and Devices that is required for importing pesticides and pesticidal devices into the United States. These revisions should increase the efficiency of the Notice of Arrival process.

If you are an importer of pesticides or pesticidal devices, you should begin using the updated form immediately.

Where can I access the updated form?

The form can be accessed at: http://www.epa.gov/compliance/resources/publications/monitoring/fifra/noaform.pdf.

What has changed?

Changes include clearer instructions and terms on the form. A new, optional section was also added for the importation of un-registered pesticides, developed in accordance with the exceptions for the transfer, sale and distribution of pesticides without registration under 40 CFR 152.30. You can now voluntarily check boxes as appropriate and provide additional information to expedite the Notice of Arrival processing. In addition, you are encouraged to include a copy of the label when submitting the NOA form to the EPA.

Why were the changes made?

The EPA and stakeholders identified the need for a clearer form to improve the efficiency of the NOA process. In late 2011, the EPA published a Federal Register notice, available at  www.regulations.gov under Docket ID No. EPA-HQ-OPP-2011-0843, announcing the renewal of the form and requested comment on proposed changes to the instructions. The finalized form incorporates public comments and was developed in cooperation with the EPA Regions and U.S. Customs and Border Protection.
