TSCA Section 11(c) Subpoenas
Section 11(c) of the Toxic Substances Control Act gives EPA the authority, in carrying out the provisions of TSCA, to use a subpoena to require the attendance and testimony of witnesses and the production of reports, papers, documents, answers to questions, and other information that the Administrator deems necessary. It provides that witnesses would be paid the same fees and mileage that are paid witnesses in the courts of the United States. If a person fails or refuses to obey the subpoena, section 11(c) establishes that any United States district court with proper venue has jurisdiction to order the person to comply. Any failure to obey such an order of the court is punishable as contempt of court.
