More Information About State Delivery Prohibition Programs Now Available Online
December 18 – EPA is making more information about underground storage tank delivery prohibition programs available online with our new Underground Storage Tank Delivery Prohibition Web Area. These pages provide links to state and territory laws, regulations, and policies in order to help users determine the applicable requirements in each state and territory.
Delivery prohibition programs prohibit product delivery to underground storage tanks that have one or more compliance violations. States and territories that have programs generally use one of two methods for identifying the delivery eligibility status of USTs:
- Red Tag Programs, which physically identify USTs that are ineligible to receive product. If an UST does not have a red tag, then the deliverer can assume that the tank is compliant and eligible for delivery.
- Green Tag Programs, which physically identify USTs that are eligible to receive product. If a green tag or permit is present, then the deliverer can assume the tank is compliant and eligible for delivery.
The Energy Policy Act of 2005 (PDF) (551 pp, 3.1 MB, About PDF) required that EPA develop delivery prohibition grant guidelines for states, which EPA did in August 2006. States receiving Subtitle I funding were required to meet the minimum requirements of the grant guidelines by August 8, 2007. Some states met the deadline; others are working to meet it. As required by the grant guidelines, many states will be altering their delivery prohibition programs to comply with the 2006 requirements. The Delivery Prohibition Web Area will be updated as states develop new delivery prohibition programs.
