Public Record

Requirement

Section 1526 of the Energy Policy Act of 2005 requires states receiving federal funds under Subtitle I of the Solid Waste Disposal Act to maintain, update at least annually, and make available to the public a record of underground storage tanks regulated under this subtitle. The public record shall include (to the maximum extent practicable, for each year) the number, sources, and causes of underground storage tank releases, the record of compliance by underground storage tanks in the state with Subtitle I or approved state program, and data on equipment failures.

Deadlines

States receiving federal funds must develop a program and begin gathering data to meet the public record requirement by October 1, 2007.

Status

On January 22, 2007, EPA issued the public record guidelines (PDF) (13 pp, 132K, About PDF) which discuss developing and updating the public record; making the public record available; describing the minimum public record content; ensuring data quality; and demonstrating and ensuring compliance with the guidelines. States receiving federal funds must develop a program for gathering information and begin gathering data to meet the public record requirement by October 1, 2007. EPA regions will incorporate the guidelines into their future grant agreements with states.
