Proposed Revisions to the Regulatory Definition of "Fill Material" & "Discharge of Fill Material" 65 Fed. Reg. 21292 (April 20, 2000)(PDF) (10 pp, 245K, About PDF) - On April 20, 2000, a joint Army/EPA proposed rule was printed in the Federal Register proposing to revise the Clean Water Act section 404 regulations defining the term "fill material." 65 Fed. Reg. 21292. The Army and EPA definitions of "fill material" currently differ from each other, and this has resulted in regulatory uncertainty and confusion. The proposal would amend both the Army regulations (33 C.F.R. 323.2(e)) and the EPA regulations (40 C.F.R. 232.2 ) to provide a single consistent definition. The proposal also would make conforming changes to the related definition of "discharge of fill material."
