Regulatory Action Being Announced:
- Risk Assessments and Proposed Registration Decision added to docket: October 15, 2009. EPA is making its proposed registration decision, called a "Biopesticides Registration Action Decision (BRAD)," available for comment. The BRAD contains EPA's proposed registration decision and risk assessment. In addtion, EPA is making the proposed product labels available for comment. Comments will be available through November 14, 2009.
- Exemption from the requirement of a tolerance for Cold Pressed Neem Oil in or on all food commodities: October 15, 2009. Comments will be accepted through November 14, 2009.

Instructions for Commenting During Open Comment Periods:
Unlike comment periods associated with the initial opening of a docket, which are announced in the Federal Register, second comment periods that are part of EPA’s public participation process for pesticide registration are only announced on the Pesticide Registration Application Status page. Doing so saves taxpayer dollars since there is a cost for each Federal Register Notice publication.
Some dockets may indicate that a comment period has closed even though an open comment period has been announced on the Pesticide Registration Application Status page. The most likely cause of this is that the initial comment period announced in the Federal Register is closed, which has no impact on the second comment period provided by the public participation process. The closing date for the second comment period on EPA’s risk assessments and proposed registration decision is indicated in the Application Status area above.
Specific instructions for comments are included in the Federal Register Notice(s) listed above. All comments received during open comment periods will be added to the docket for this chemical at regulations.gov.
Submitting Confidential Business Information (CBI) with comments: EPA expects that most comments will not contain CBI. However, if comments do contain CBI, do not submit this information to EPA through regulations.gov or e-mail. Clearly mark the part or all of the information that you claim to be CBI. For CBI information in a disk or CD-ROM that you mail to EPA, mark the outside of the disk or CD-ROM as CBI and then identify electronically within the disk or CD-ROM the specific information that is claimed as CBI. In addition to one complete version of the comment that includes information claimed as CBI, a copy of the comment that does not contain the information claimed as CBI must be submitted for inclusion in the public docket. Information so marked will not be disclosed except in accordance with procedures set forth in 40 CFR part 2.
