Action Code Interpretation:

An application for a product containing a new microbial or biochemical pesticide active ingredient.  The proposed use meets the definition of a food use, requires that the applicant submit data to enable the Agency to conduct a dietary exposure assessment and may require that the applicant submit a petition for an exemption from the requirement of a tolerance for the active ingredient.

All uses (food and non-food) included in any original application or tolerance exemption petition for a new active ingredient are covered by the base fee for the application in this category if submitted simultaneously.
