In November 2009, Beeland Group LLC, Inc. of Jackson, Mich., a subsidiary of Consumers Energy (CMS), applied for a permit to construct and operate a Class I injection well at the CMS Lands remediation facility. CMS is the party responsible for cleaning up liquid waste called leachate that is coming from cement kiln dust buried under CMS's Bay Harbor resort development. The injection well is intended as a permanent disposal method for the leachate that currently is trucked off-site.

February 2012
EPA issued the final permit and its response to comments regarding the draft permit on February 8, 2012. No requests for administrative review by the Environmental Appeals Board were submitted, so the permit became effective March 9, 2012.

In 2008, Beeland Group received a permit to construct and operate a Class I injection well at the Alba facility in Antrim Coutny, MI to dispose of leachate from the Bay Harbor resort development. The state permit was appealed and the Alba well was put on hold.

The flowchart below shows the main steps that EPA follows to process a permit application from start to finish.
- Receive the permit application. November 2009
- Conduct a completeness review and technical evaluation. November 2009 - December 2010
- Make a draft decision, announce the draft decision and public comment period and accept public input by mail and at public hearing. December 2010
- Prepare responses to public comments.
- Issue final decision and distribute responses to public comments. February 2012
- If the final decision is appealed, process the appeal.
