U.S. EPA Proposes to Remove Site in Smyrna, Delaware from Superfund List

The U.S. Environmental Protection Agency (EPA) asks the public to comment on its proposal to remove the Tyler Refrigeration Pit Site from the Superfund List (known formally as the National Priorities List or NPL). Data collected since 1997 show that contaminant levels in the site groundwater have decreased to levels near or more protective than the current drinking water standards or riskbased concentrations.

Monitoring and a Five-Year Review of the site have shown that no further cleanup action is needed to protect human health and the environment. Groundwater contamination has not moved beyond the site, and the State has designated the site and surrounding areas a Groundwater Management Zone (GMZ). No wells exist or may be installed within the GMZ. The Delaware Department of Natural Resources and Environmental Control (DNREC) agrees with EPA's proposal to delete the site.

After the site is deleted from the NPL, groundwater monitoring, site inspections, and Five-Year Reviews will continue to be conducted to ensure that the cleanup measures remain effective. The next Five-Year Review will be performed in 2007.

PLEASE NOTE: EPA will consider and respond to all comments opposed to removing the site from the NPL before deciding whether to proceed with the deletion. If no objections are presented, the site deletion will become effective on March 29, 2004.

SITE BACKGROUND: Contamination is thought to have resulted from storage and handling practices at the former facility. On-site disposal pits, once used to hold spent cleaning solvents and sludge, were removed in the late 1970s. EPA's 1996 Record of Decision required ground water monitoring, which has been done since 1997.
